Estate planning is the process of designating who will receive your assets and handle your responsibilities after your death or incapacitation. It can also involve selecting a guardian for minor children, determining their education, and providing for their medical care if needed. The average cost of an estate plan is $3,400-$10,000 when you include attorney fees and other expenses. And it's worth every penny because without a plan in place many people end up paying more in taxes than they need to or lose control of their assets to someone they would never have chosen. Your personal situation dictates how much estate planning you might need but there are some things that almost everyone should consider including wills, powers of attorney (both living and durable Probate is the legal process for the distribution of a person's assets at death. The estate is administered by an executor or administrator who collects all property, pays any debts and taxes, and distributes it to beneficiaries with due regard for their interests. Probate can be easier when someone leaves his or her will in order to specify what they want done with their property after death. It usually takes about six months to complete probate in most situations.
